    Pennsylvania currently does not have minimum sentencing requirements for a drug distribution PWID conviction – the U.S. Federal Court system does. This means spending at least one year in prison, depending on the quantity of the drug and type of drug.

    Under current Pennsylvania law the manufacturing, cultivation, or distribution of controlled substances (drugs) all fall under the offense of Possession With Intent to Deliver (PWID).  Each of these acts is considered to demonstrate, at least, an intent to sell or distribute drugs.

    The penalties for each of these acts are the same, and are not directly related to weight or volume with the exception of marijuana where the possession of 1000 lbs or more carries enhanced penalties.
