Know Your Rights. Fight for Them.

If you have been charged with Possession With Intent to Deliver (PWID) for manufacturing or cultivating (growing) drugs such as marijuana, you are facing some tough penalties, if convicted.

Usually a PWID is considered a felony and even a first offense can land you a minimum of one year in prison and a $5,000 fine. This doesn’t include any forfeiture of cash or property, such as your house or car, which the government may try to confiscate and resell if the alleged crime took place in your home or vehicle.

You have been charged with PWID in PA you were suspected of any of the following:

    What is Drug Manufacturing?

Drug manufacturing can mean running a drug laboratory, conspiring with others to manufacture drugs, growing marijuana, or running a meth lab.

“Manufacture” means the production, preparation, propagation, compounding, conversion or processing of a controlled substance, other drug or device or the packaging or repackaging of such substance or article, or the labeling or relabeling of the commercial container of such substance or article, but does not include the activities of a practitioner who, as an incident to his administration or dispensing such substance or article in the course of his professional practice, prepares, compounds, packages or labels such substance or article. The term “manufacturer” means a person who manufactures a controlled substance, other drug or device (35 Pa. Stat. § 780-102).

The type of drug you are charged with manufacturing or cultivating will determine the amount of fines you will have to pay and the amount of prison time you may have to endure, if convicted.

It is important to remember that a drug charge is not a conviction. You have to be proven guilty to be convicted and face the penalties.

Sentencing & Penalties for Manufacturing Drugs in PA

Under current Pennsylvania law the manufacturing, cultivation, or distribution of controlled substances (drugs) all fall under the offense of Possession With Intent to Deliver (PWID).  Each of these acts is considered to demonstrate, at least, an intent to sell or distribute drugs.

The penalties for each of these acts are the same, and are not directly related to weight or volume with the exception of marijuana where the possession of 1000 lbs or more carries enhanced penalties.

Both Pennsylvania and the U.S. Federal Government have minimum sentencing requirements for a drug manufacturing PWID conviction. You may also face Federal Charges for manufacturing drugs, in addition to being tried by Pennsylvania.

Talking with an experienced drug crime attorney like David J. Shrager is the best way to know what types of penalties you face, given your circumstances. However, below are some general guidelines for sentencing.
